Elephants show a rich social organization and display a number of unusual traits. In this paper, we analyse reports collected over a thirty-five year period, describing behaviour that has the potential to reveal signs of empathic understanding. These include coalition formation, the offering of protection and comfort to others, retrieving and 'babysitting' calves, aiding individuals that would otherwise have difficulty in moving, and removing foreign objects attached to others. These records demonstrate that an elephant is capable of diagnosing animacy and (...) goal directedness, and is able to understand the physical competence, emotional state and intentions of others, when they differ from its own. We argue that an empathic understanding of others is the simplest explanation of these abilities, and discuss reasons why elephants appear to show empathy more than other non-primate species. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Background: Electroconvulsive therapy is one of the most effective treatments for major depressive disorder. Recently, there has been increasing attention to evaluate the effect of ECT on resting-state functional magnetic resonance imaging. This study aims to compare rs-fMRI of depressive disorder patients with healthy participants, investigate whether pre-ECT dynamic functional network connectivity network estimated from patients rs-fMRI is associated with an eventual ECT outcome, and explore the effect of ECT on brain network states.Method: Resting-state functional magnetic resonance imaging data were (...) collected from 119 patients with depression or depressive disorder, and 61 healthy participants, with an age mean of 52.25 years old. The pre-ECT and post-ECT Hamilton Depression Rating Scale were 25.59 ± 6.14 and 11.48 ± 9.07, respectively. Twenty-four independent components from default mode and cognitive control network were extracted, using group-independent component analysis from pre-ECT and post-ECT rs-fMRI. Then, the sliding window approach was used to estimate the pre-and post-ECT dFNC of each subject. Next, k-means clustering was separately applied to pre-ECT dFNC and post-ECT dFNC to assess three distinct states from each participant. We calculated the amount of time each subject spends in each state, which is called “occupancy rate” or OCR. Next, we compared OCR values between HC and DEP participants. We also calculated the partial correlation between pre-ECT OCRs and HDRS change while controlling for age, gender, and site. Finally, we evaluated the effectiveness of ECT by comparing pre- and post-ECT OCR of DEP and HC participants.Results: The main findings include depressive disorder patients had significantly lower OCR values than the HC group in state 2, where connectivity between cognitive control network and default mode network was relatively higher than other states, Pre-ECT OCR of state, with more negative connectivity between CCN and DMN components, is linked with the HDRS changes. This means that those DEP patients who spent less time in this state showed more HDRS change, and The post-ECT OCR analysis suggested that ECT increased the amount of time DEP patients spent in state 2.Conclusion: Our finding suggests that dynamic functional network connectivity features, estimated from CCN and DMN, show promise as a predictive biomarker of the ECT outcome of DEP patients. Also, this study identifies a possible underlying mechanism associated with the ECT effect on DEP patients. (shrink)

This report describes the rationale, approaches, organization, and resource development leading to a large-scale deletion bin map of the hexaploid wheat genome. Accompanying reports in this issue detail results from chromosome bin-mapping of expressed sequence tags representing genes onto the seven homoeologous chromosome groups and a global analysis of the entire mapped wheat EST data set. Among the resources developed were the first extensive public wheat EST collection. Described are protocols for sequencing, sequence processing, EST nomenclature, and the assembly of (...) ESTs into contigs. These contigs plus singletons were used for selection of distinct sequence motif unigenes. Selected ESTs were rearrayed, validated by 5′ and 3′ sequencing, and amplified for probing a series of wheat aneuploid and deletion stocks. Images and data for all Southern hybridizations were deposited in databases and were used by the coordinators for each of the seven homoeologous chromosome groups to validate the mapping results. Results from this project have established the foundation for future developments in wheat genomics. (shrink)

In this paper, the authors attempt to prove there is a relationship between Borges’ “Argumentum ornithologicum” and Anselm’s argument “Argumentum ontologicum”. We suggest Borges, using the image of a flock of birds, with oriental reminiscences, half joking, half serious attempts to prove the existence of God. We demonstrate the fallacies incurred by Borges and why his “Argumentum” has no place within the traditional set of ontological arguments. However, it would easy to forget that Borges’ claim is not philosophical, nor theological, (...) nor apologetic, but rather ironic or paradoxical. (shrink)

The introduction explain the need for how an international, inclusive discussion about the range of different methodological approaches from different traditions of philosophy can be read alongside each other and be seen in sometimes very critical conversation with each other. In addition, the introduction identifies four broad themes in the volume: the largest group of chapters advocate methods that promote history of philosophy as an unapologetic, autonomous enterprise with its own criteria within philosophy. Second, three chapters can be seen as (...) historicizing the history of philosophy from within. Third, four chapters argue for history of philosophy as a means toward making contributions to contemporary philosophy. This paper discusses the first incarnation of what came to be known as the “Frege-Geach” point. The point was made by Peter Geach in his 1960 essay “Ascriptivism”, and developed in “Assertion”, a 1965 piece. Geach’s articles launch a wholesale attack on theories of non-descriptive performances advanced by “some Oxford philosophers” whom he accuses of ignoring “the distinction between calling a thing ‘P’ and predicating ‘P’ of a thing”. One view that Geach specifically targets is H. L. A. Hart’s claim (...) that sentences of the form “X φ-ed” are not primarily descriptive but ascriptive of responsibility for actions. Hart explicitly accepted Geach’s criticism, and disowned his essay. I argue that he was wrong to do so. Perhaps the essay was worth retracting, but not because of Geach’s objections. I begin by restating and refining Geach’s arguments, in order to bring out the flaw he claimed to have detected in the “pattern of philosophising” that he took Hart’s essay to exemplify. I go on to argue that Geach’s original point poses no obstacle either to non-descriptivism in general, or to Hart’s sui generis non-descriptivist claim in particular. (shrink)

Bonhoeffer dira plus tard qu’il a « découvert » la Bible en donnant ce cours sur « Création et chute » en 1932-33. Il a voulu faire un « exercice » d’« exégèse théologique », comprise comme relecture de toute l’écriture à partir de la fin de la création dans le Christ. Les allusions au nazisme qui vient de prendre le pouvoir en Allemagne montrent Bonhoeffer soucieux de lui opposer une anthropologie théologique qui soit la prise en compte, dans l’écriture, (...) de toute la réalité humaine dévoilée à la lumière du monde nouveau.Notons quelques idées maîtresses de cette anthropologie : la résurrection du Christ est ce qui révèle l’acte créateur comme appel à l’être ; la Parole créatrice donne forme au réel ; l’appartenance commune des hommes à la terre fonde leur co-humanité, chacun advenant à la liberté par sa relation à l’autre ; la limite est grâce et le refus de la limite, l’origine du mal ; l’union de l’homme et de la femme dans la différence signifie et l’acceptation de la limite et l’accueil de la grâce, que chacun est pour l’autre ; l’église se fonde et se signifie dans cette communauté humaine différenciée et réconciliée.Later in his life Bonhoeffer will say that he “discovered” the Bible in giving his course on “Creation and Fall” in 1932-33. The allusions to Nazism that came to power in Germany show Bonhoeffer’s concern to oppose it with a theological anthropology. It would take into account, in Scripture, all human reality unveiled in the light of a new world.Let us note some key ideas of this anthropology : Christ’s resurrection is that which reveals the creative act as a call to being ; the creative Word gives form to the real ; the common appartenance of men to the earth establishes their co-humanity, each approaching freedom by his relation to the other ; grace is the limit and refusal of the limit is the origin of evil ; the union of man and woman in their differences signifies both the acceptance of the limit and the reception of grace, what each one is for the other ; the Church establishes and gives itself meaning in this human community that is differentiated and reconciled. In the line traced by the works of Paul Ricœur, familiar to exegetes, biblical hermeneutics should be preoccupied with the connection between human thought and the life of the universe, the rapport of scripture to law and ethics, and the profound harmony of religious thought with symbolic language. Scripture is, indeed, one of the techniques by which human beings, since their origin, assure their control over the universe. Writing serves to codify life in society and the functioning of authority. Le dialogue requiert au moins deux personnes. Encore faut-il s'entendre, notamment dans le dialogue interreligieux, sur la définition de la "personne". Rien là d'évident, contrairement aux apparences : à chaque définition du Dieu vivant correspond une définition du croyant dans chaque fibre de son être. D'où la nécessité d'une anthropologie du dialogue, où chacun s'interrogerait : "Y a-t-il réciprocité, de sorte que lui et moi nous considérions comme des égaux?" Cette anthropologie, l'auteur, dès les années 1960, a entrepris de la (...) fonder, en conjuguant Tradition musulmane et philosophie occidentale (française principalement). Homme de foi, il présente d'abord l'islam d'une façon claire et synthétique, mettant en relief la dimension de témoignage ; puis il examine les réserves que l'islam peut rencontrer chez un Occidental (transcendance et athéisme, statut de la femme, de l'esclave, des minorités...) ; enfin, face au danger de dépersonnalisation de la culture musulmane, il tente de montrer en quoi l'islam est une "religion d'espoir". La médecine contemporaine bénéficie d’une prodigieuse efficacité technique. Pourtant, paradoxalement, les griefs à son encontre lui dessinent fréquemment le profil d’une accusée : l’objectivité, la rationalité de la science médicale ne font pas bon ménage avec la parole du malade. Dans la consultation médicale, plus exactement dans le contrat qui unit l’usager à un prestataire de soins, n’y a-t-il que des droits pour le premier et des obligations pour le second ? Droit d’avoir les enfants que l’on veut et devoir (...) de proposer le dernier équipement technique ? Un « testament de vie » est-il contraignant pour les soignants ? La médecine doit-elle accéder à toutes les demandes et s’occuper du bonheur ? L’article discute l’enjeu de ces interrogations. Celui-ci est peut-être lié à une question de sens, c’est-à-dire d’interaction entre la signification de la pratique médicale, la direction que celle-ci veut, peut ou doit prendre, et sa perception dans les représentations mentales. En dépit de témoignages explicites d'auteurs anciens, auxquels des historiens modernes ont fait confiance, la date tardive du Phèdre ne fait plus de doute. Ce résultat est dû aux études stylistiques bien plus qu'aux travaux d'exégèse. Quand il s'agit de définir le sens et le but du dialogue ou de démêler les liens qui le rattachent aux autres dialogues ou à des écrits contemporains, on est loin d'aboutir à un accord. Platon veut-il simplement établir le programme d'une rhétorique philosophique pour (...) faire pièce à l'action envahissante des écoles de rhétorique ? Vise-t-il plus spécialement telle ou telle doctrine rhétorique ? Vu les points de contact avec des écrits d'Isocrate, d'Alcidamas et d'autres, a-t-il peut-être voulu trancher certaines questions brûlantes, intervenir en conciliateur ou en arbitre ? Le fait est que l'examen dialectique se termine à la p. 272b par la récapitulation et la réponse définitive à la question posée p. 258d et reprise p. 259e. Alors que le débat portait sur le logos en tant que discours écrit ou prononcé, Socrate introduit dans la finale la notion du logos de l'âme pour répondre aux objections de Phèdre. Alors qu'il a prouvé (261e-262b) la nécessité de la connaissance de la vérité, peu importe de quel genre de discours il s'agit, il revient en arrière pour discuter à nouveau la théorie de la vraisemblance de Tisias appliquée au seul genre judiciaire. Pourquoi, après chacune des objections (273d-274a, 278bc) répéter la conclusion finale et reprendre coup sur coup le problème de l'œuvre écrite, qu'il avait expédié en passant, p. 257d-258d ? Au terme de cette dernière diversion, Socrate oppose à la philosophie les techniques spéciales qui lui sont subordonnées : législation, poésie, éloquence. Est-ce peut-être dans ce message destiné à Lysias et doublé d'un message analogue à Isocrate que Platon a voulu nous donner la clef de l'œuvre ? Le Phèdre été conçu comme un drame parfait axé sur la mission et la condamnation de Socrate et cette structure lui donne son sens et son unité. Le cœur, c'est la péripétie et cette „reconnaissance” dans laquelle le daimonion ouvre les yeux de Socrate. Ecoutant son daimonion, il embrasse ses dieux à lui, son Eros, et dès lors sera traité d'impie par le jury. Les politiques, les poètes et les orateurs impuissants à appuyer leurs paroles (par la philosophie) (273c) deviendront ses accusateurs, et c'est Socrate qui, ignorant leur éloquence, sera impuissant à se défendre. On lui reprochera de corrompre la jeunesse. C'est que son discours ici se termine par cette prière significative : „Accorde-moi... d'être, plus encore qu'à présent, en crédit auprès des beaux garçons” (257a trad. Robin). Bref, la scène du Phèdre est le prélude, ou, si l'on veut, la contre-partie du drame de 399. Quel est le rôle de Lysias ? Exactement le même que dans la République et le Clitophon. Contrairement à son frère Polémarque (257b) il ne pense que politique et barreau, une politique qui en définitive adopte les principes de violence de Thrasymaque (Rép. I et Phèdre 266c). Dans une soi-disant Défense de Socrate, il a répondu à Polycrate en ramenant toute l'affaire sur le plan purement politique et en reniant le verdict de 399, imputable à l'absence d'une défense efficace. Soucieux du relèvement de la démocratie, il désire reléguer à l'arrière-plan l'affaire de 399, faire oublier les griefs religieux et peut-être tendre la main aux Socratiques, pour, ainsi, passer à l'ordre du jour. Or, se prêter à cette manoeuvre, pour Platon, c'est renier son maître. Que reproche-t-il à Lysias ? De tourner le dos à la Philosophie en médisant d'Eros. Et nous apprenons en finale, pour mettre fin à toute équivoque, qu'Isocrate n'échappe pas à ce même reproche. Mais tout cela se situe à l'arrière-plan. Dans la trame du Phèdre, celui qui est directement accusé d'impiété, celui qui s'accuse lui-même, c'est Socrate. S'il n'y avait vu clair, s'il avait quitté ce lieu sacré après un succès oratoire sur un thème imposé par Lysias, il aurait renié ses daimonia ; il aurait trouvé grâce auprès des hommes, mais serait justiciable des dieux (242d). Dans ce cas le drame, le vrai drame du Phèdre, n'aurait pas eu lieu et Socrate aurait échappé à son arrêt de mort. (shrink)

Le débat engagé dans le Phèdre à la suite des trois discours, constitue une enquête dialectique qui ne se limite pas, comme dans le Gorgias, aux seuls genres étudiés par les rhéteurs et sophistes, à savoir l'éloquence du barreau et de la tribune politique. Il examine toute la rhétorique en tant qu'art de conduire ou de provoquer l'âme. Tout discours, à quelque genre qu'il appartienne, est sujet à contradiction : en rhétorique comme en dialectique celui-là est le meilleur qui voit (...) la vérité, parce que, connaissant le pour et le contre, le vrai et le semblant de vérité, il saura défendre l'une et l'autre thèse. C'est là une doctrine reçue dans l'Académie. Pour la mettre en évidence Platon a recours à l'exemple des trois discours. Celui de Lysias, faute d'avoir établi une définition qui en soit le principe ou commencement, manque de suite et „nage à rebours". Les deux discours de Socrate posent un principe. Dans le premier une définition conventionnelle de l'amour le conduit à blâmer celui-ci, à juste titre. Vrai en lui-même, ce discours devient faux du moment qu'on lève la convention : or, dans le cas présent, il faut la lever, parce qu'elle méconnaît le divin. Sur l'intervention du „ signe" avertisseur, Socrate le corrige et le complète par le second discours, dont le principe n'est plus conventionnel et hypothétique, mais absolu : l'âme, principe moteur de tout. Nous avons ici l'antilogie parfaite qui repose sur l'unité de formes opposées, „l'un qui s'épand en multiplicité". Platon a choisi comme sujet l'amour parce que c'est lui qui, en tant qu'intermédiaire, unissant l'humain et le divin, réalise éminemment cette unité-multiplicité. L'exposé de la méthode diérétique contient bien des éléments que nous retrouverons dans les dialogues métaphysiques, mais nous aurions tort de la confondre avec celle du Sophiste, qui opère sur des notions „humaines" et a comme but de définir la forme indivisible en la cernant par une chaîne de divisions dichotomiques. Ici, grâce au mythe, il opère la jonction avec le trancendant, et il prouve que, par son caractère antilogique, le discours complet correspond à la structure de l'être un et multiple en affirmant l'unité et la contrariété des formes non-homonymes qui la constituent. Ce ne sont donc pas des exercices de dialectique formelle opérant sur de purs concepts. L'unité en question est réalisée dans l'ordre transcendant des Idées et c'est la réminiscence qui nous permet de la saisir et de reconnaître ainsi les rapports logiques et ontologiques à la fois entre les choses perçues. Cette méthode, nous devons la suivre „ pour être à même de parler et de penser". En fondant la rhétorique sur la dialectique, Platon entend reléguer au second plan les facteurs émotionnels que, sous l'influence du théâtre, la rhétorique attique d'inspiration Gorgienne avait mis en évidence comme constituant l'essence de la rhétorique. Après avoir, ici, revendiqué pour la dialectique la place qui lui revient, Socrate nous dira dans la suite ce que valent ces moyens et quel parti on peut en tirer. Il importe de bien distinguer ces deux thèses, comme Platon a eu soin de le faire. La première nous renvoie à la dialectique, la seconde à la philosophie de la nature. (shrink)

L'ordre infra-humain connaît-il un déroulement historique ? A cette question il faut répondre par la négative, du moins si l'infra-humain est considéré en soi, indépendamment de sa relation à l'humain. Seul l'homme peut donner un sens aux processus de la nature, qui, sans lui, ne possèdent aucune intelligibilité ni même ne peuvent exister. Pour élaborer cette thèse, il faut commencer par définir ce qu'est l'histoire en tant qu'enchaînement de faits. Un fait a nécessairement un certain caractère « événementiel » et (...) surgit toujours d'une manière imprévue, inattendue. Pour l'intelligence subsistante qui, elle, n'a rien d' « événementiel », un pareil fait n'existe pas, tandis qu'au contraire pour une intelligence qui est à elle-même un événement, les faits existent et même lui opposent une irréductible résistance. La connaissance de l'histoire est intrinsèquement liée à une intelligence qui est ellemême, dans une certaine mesure, historique dans son mode de connaître. Une histoire de la nature s'articule nécessairement à une histoire de l'homme. Et plus une connaissance passe à l'absolu, moins il subsiste d'histoire authentique. La place de l'homme dans l'univers est par là indiquée. Comme centre et terme de perfection de l'univers matériel, l'homme est le seul vrai porteur d'histoire ; il est le sujet pour qui tout le reste est objet. Mais un objet qui n'est pas objet pour un sujet, perd son objectivité. L'auteur note ici les points de divergences entre sa conception et celle concernant l'histoire chez Hegel comme aussi celle concernant l'historicité chez Heidegger et Jaspers. L'expression « centre de l'univers » est précisée à la lumière de ces mises-au-point. En conclusion, la thèse défendue est confrontée à ce que dit de la « finis creationis » la théodicée scolastique. La fin de la création est la gloire formelle extrinsèque de Dieu. Si donc il n'y avait pas de pensée dans la sphère matérielle, en d'autres mots si l'homme n'existait pas, il ne pourrait être question que de gloire objective, qui même perdrait son objectivité, puisque le sujet corrélatif serait inexistant. Ceci ne signifie évidemment pas qu'il a toujours fallu des hommes sur terre, ni non plus que l'homme doit avoir une omniscience exhaustive. L'intellect humain est moins encore à considérer comme un point d'appui nécessaire à la pensée divine pour prendre conscience de soi. (shrink)

There is but a mere hint of how atomistic philosophy was handled by the Aristotelians and to what extent they actually absorbed some of that tradition themselves. Nothing in detail is said of the process whereby atomistic and Platonic motives became coupled, not only by Bruno, (...) but by Ficino before and by Cudworth afterwards. On the credit side, however, the author does call attention to the commentary and paraphrase of Lucretius by Girolamo Frachetta of Rovigo (printed 1589), a work of some interest, which has been but little studied. Such rays of light are all too infrequent in this section and Papi is usually content to follow the conventional beaten path. For one to write a book on Bruno which breaks new ground is now difficult, for the field has been so thoroughly worked over. This one takes up a number of interesting themes found in Bruno's writings and sheds some light on them, but it seldom if ever says anything very different from the well-established tradition of Bruno scholarship in Italy which has produced so many mediocre books over the years. The specialist on Bruno and the sixteenth century will find little to detain him; the more casual reader could be ~rected to a number of superior treatments of various aspects of the Nolan's thought. In short, this study adds but little to what is already known. CHAm~V_SB. ScH~rrr University of Leeds Sir Walter Ralegh dcrivain, l'~uvre et les iddes. By Pierre Lefranc. (Qutbec: Les Presses de l'Universit~ Laval, 1968. Pp. 733. $19.50) This excellent study, the fruit of more than a dozen years of research, throws much light on Ralegh's thought and literary achievement. Lefranc has examined the manuscript sources, and unearthed quite a few new ones, and has patiently, carefully, and with much detective work, established what is no doubt the best available hypothesis of what is authentic among Ralegh's purported prose and poetic writings, and the date and circumstances of their composition. He has analyzed them in the context of Ralegh's carver, and has developed an exciting and rich interpretation of his political, philosophical and religious ideas. Ralegh's role in intellectual history derives mainly from his reputation as a Machiavellian, as an atheist, and from his mammoth, "pious," much-read providential History of the World (written during his years as a prisoner in the Tower of London). Lefranc deftly sorts and weighs the evidence for the various views and attitudes attributed to Ralegh in his own day and by interpreters ever since, and emerges from this examination with a fresh and striking picture of one of the liveliest bridge figures between the Elizabethan Renaissance and the modern world. The establishment of the canon leads to discarding as not by Ralegh many writings that have previously been used in interpreting the courtier's views. Three philosophical works which have played a role in twentieth-century interpretation, "A Treatise of the Soule," "The Prince, or Maxims of State" and "The Sceptick" are shown to be doubtful to a greater or lesser degree. "The Sceptick," which Strathmann (Sir Walter Ralegh,,4 Study in Elizabethan Skepticism, New York, 1951) had used to interpret Ralegh as a sceptical-Christian fideist, had been questioned earlier by Lefranc, Sprott, and myself. It is just a translation of portions of Book I of Sextus F_znpiricus' Outlinea of Pyrrhonism, and contains no connection with Ralegh, except that it was BOOK REVIEWS 213 published in his literary remains in 1651. Lefranc now, examining the evidence of the four manuscripts that have been discovered, concludes that it was a part of Ralegh's documentation when he was doing his research, but that 'Tattribution de 'The Sceptick' Ralegh lui-m~me ne repose sur rien" (p. 67). With the canon shorn of the dubious items, Lefranc proceeds to unfold a picture of Ralegh's intellectual world. A representation is a remnant of previous experience that allows that experience to affect later behavior. This paper develops a metatheoretical view of representation and applies it to issues concerning representation in animals. To describe a representational system one must specify the following: thedomainor range of situations in the represented world to which the system applies; thecontentor set of features encoded and preserved by the system; thecodeor transformational rules relating features of the representation to the corresponding features of the represented (...) world; themedium, or the representation's physical instantiation; and thedynamics, or how the system changes with time. In part because of the behaviorist assumption that the hypothetical, covert changes occurring in an organism during learning correspond to the overt physical changes that are observed, issues of representation in animal behavior have been largely ignored as irrelevant or misleading. However, it can be inferred that representations, acting as models of environmental regularities, operate at many levels of behavioral functioning, both cognitive and noncognitive. Objections to the use of this concept in explanations of animal behavior, based on the claim that it is indeterminate and on behaviorist considerations of parsimony, can be answered. Animal representations may be specialized in terms of tasks and species. Data from tasks involving spatial memory, delayed matching-to-sample, and sequence learning suggest some foundations for a general theory of animal representations. (shrink)

In his introduction to these closely linked essays Professor Hart offers both an exposition and a critical assessment of some central issues in jurisprudence and political theory. Some of the essays touch on themes to which little attention has been paid, such as Bentham's identification of the forms of mysitification protecting the law from criticism; his relation to Beccaria; and his conversion to democratic radicalism and a passionate admiration for the United States.

Kant el papel de la imaginación y los efectos del “como si”.This essay demonstrates the structural relationship between testimony and aesthetic judgment. The implications of this discovery are several, the most important being the relationship between the lie and truth, implicating that lie indicates the irreducible possibility of truth. The essay explains the necessary impossibility of the testimony as a condition of its possibility, an argument anticipated in Jorge Luis Borges’ beautiful phrase, “There is not a single beautiful word, with the dubious exception of witness, that is not an abstraction”. The argument is based on Husserl’s theory of the syncategorem and on deictic words ; as well, it takes from Kant, the role of the imagination and the effects of the “as if”. (shrink)

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. Dans ses recherches empiriques, philosophiques et métaphysiques la conscience humaine ne sort pas de sa propre sphère. C'est toujours la conscience qui parle. Par sa connaissance l'homme ne peut dépasser la conscience directe. Par sa pensée il tend à dépasser médiatement la conscience. Cette constatation nous est dictée par le fait scientifiquement fondé que tant la conscience humaine que son contenu sont tirés, c.a.d. révélés, des profondeurs cachées où ils sont recélés. C'est ce qui rend évident que l'homme possède un (...) merveilleux "sens sondeur", lui permettant de reconnaître les hauteurs et les profondeurs de notre conscience et aspirant à la transcendance. Le domaine de l'expérience se borne nécessairement aux phénomènes, et tandis que celui de la philosophie s'étend au fondement de ces phénomènes et à leurs rapports réciproques, la métaphysique, la science des principes, se propose de pénétrer l'origine et le sens profond de toute chose, du néant à l'ultime perfection. Après Kant qui a voulu en finir avec la métaphysique dogmatique unilatéralement déductive, la méthode inductive a pris définitivement le dessus. Cette méthode ne s'arroge pas le droit de juger d'une façon apodictique en ce qui touche aux problèmes de l'existence, qui ont donné naissance aux dispositions de la conscience humaine. Elle s'efforce, au contraire, de faire en cette matière une large part à l'inconnu en démontrant que les résultats sont heuristiques, hypothétiques et problématiques. Ainsi la théorie de la connaissance, la philosophie et la théologie s'accordent à dire que les données microcosmiques dans la sphère de la conscience humaine peuvent être les représentants des entités macrocosmiques. Si la conscience humaine poursuit ses recherches philosophiques et métaphysiques, c'est qu'elle doit sa genèse à une relation universelle dont elle est la représentation. (shrink)

Les pages suivantes essaient de résumer brièvement une étude entreprise par l’auteur sur les rapports qui unissent Descartes et Comenius, étude qui sera publiée sous peu in extenso. On y joindra évidemment les textes, les extraits des documents contemporains, bref tout l’appareil scientifique assez considérable que comporte une étude de nature historique. Mais ici, à mon grand regret, j’ai été obligé de supprimer toute la documentation qui doit étayer l’exposé que l’on trouvera ci-après. Il lui manque en outre l’esquisse des (...) perspectives historiques dans lesquels se placent les événements dont j’aurai à parler. Faute de place, il a fallu se résigner, bien à regret, à quelques généralités. (shrink)

La conception aristotélicienne des principes divins est parcourue de tensions épistémologiques, archéologiques et proprement théologiques, qui constituent à la fois un défi pour Aristote lui-même et un ensemble de problèmes qu'il lègue à la tradition, qu'elle se revendique de lui, ou se fasse critique à son égard. Restituée au mouvement de la tradition, aux vicissitudes de ses relectures, la théologie aristotélicienne voit s'actualiser les potentialités qu'elle portait en son sein, et qu'Aristote lui-même, déjà, commençait d'explorer. Ce volume, sans prétendre à (...) l'exhaustivité, souhaite, par la diversité de ses contributions, donner à lire quelques-unes de ces actualisations, qu'elles soient exégétiques ou polémiques, et tracer quelques linéaments de leurs effets historiques. Dans le Philèbe de Platon, Socrate fait valoir que la vie bonne doit consister en la connaissance et le plaisir. Une partie de cette démonstration consiste en une analyse des parties de la connaissance où la connaissance peut être plus ou moins pure, plus ou moins mêlée d’éléments étrangers tels que la sensation ou l’expérience. Lorsqu’elle est pure, elle s’attache à la vérité, pure et simple. Car, nous devons l’admettre, la connaissance est vraie, quoiqu’elle puisse être d’autre par ailleurs. La (...) connaissance peut rendre les humains bons, c’est-à-dire leur permettre de bien faire, de manière fiable et souple, mais elle a son bien au-delà de l’existence humaine – elle n’est pas limitée à l’existence humaine. Nous suggérons ici que Platon détermine en fait la connaissance à partir de sa finalité – sa cause finale est utilisée pour déterminer sa cause formelle : ce que vise la connaissance nous dit ce qu’elle est. Au lieu de nous fournir une analyse selon l’aporie finale et insatisfaisante du Théétète (« l’opinion vraie accompagnée de raison »), la connaissance est ainsi dotée d’une justification fonctionnelle. Une partie de cette proposition est que la connaissance se doit d’être vraie ; c’est ce qui garantit sa stabilité : elle est à elle-même sa propre fin. Le bien de la connaissance, c’est la vérité. C’est ce qui lui permet de se comporter comme un guide pour l’âme. Les attributs additionnels de ce clan, qui est celui de la connaissance, découlent de la vérité et de leur relation à elle : exactitude, clarté et pureté. Car dans la mesure où ils sont purs et sans mélange avec des éléments étrangers tels que la pratique ou la sensation, ils ne s’intéressent qu’à des unités exactes, de choses qui sont ce qu’elles sont, de sorte que leur clarté n’est en rien troublée.
